Terms of use

1. Using TimeThis

TimeThis is a business tool for capturing crew time, preparing payroll files and reporting labor cost by job. You must be at least 18 and able to agree to these terms for your company. If you accept them for a company, you confirm that you have authority to do so, and “you” means that company.

2. Accounts

• Give accurate information and keep it current.
• Keep access to your email account secure, since sign-in codes are sent there. Do not share codes.
• You are responsible for the people you invite and what they do in your company's account.
• Tell us right away at support@timeth.is if you think your account has been used without permission.

3. Your data

You own the data you upload or enter, including employee, time, job and payroll records (“customer data”). You give us permission to host, copy, process and display customer data only as needed to provide TimeThis to you, to support you, and to keep the service secure. Our Privacy policy explains how we handle it.

You are responsible for customer data being accurate and lawfully collected, and for giving your employees any notices the law requires. Please do not upload Social Security numbers, bank account numbers or other information TimeThis does not need.

4. Payroll and job cost results

TimeThis totals hours, applies the overtime and pay settings you choose, and builds files and reports from the information you provide. It is not a payroll provider and does not give tax, legal or accounting advice. You are responsible for reviewing hours, rates, overtime and every payroll file before you send it to your payroll provider, and for complying with wage and hour laws that apply to you.

5. Acceptable use

You agree not to:

• use TimeThis for anything unlawful or to upload content you have no right to share;
• try to access another company's data, or probe, scan or test our systems without our written permission;
• interfere with the service, overload it, or get around its security or usage limits;
• upload malware, or copy, resell or reverse engineer TimeThis except where the law allows.

6. Other services

TimeThis can work with services run by others, such as your payroll provider or Google sign-in. Those services are covered by their own terms, and we are not responsible for them.

7. Fees

Some plans may be free. For paid plans, you agree to the price and billing period shown when you subscribe. Payments are processed by Stripe. Subscriptions renew automatically until cancelled, fees do not include taxes, and fees already paid are not refundable except where required by law. We will give you at least 30 days' notice before a price change applies to you.

8. Changes and availability

We keep improving TimeThis, so features may change. We work to keep it available but do not promise it will be uninterrupted or error free. We may pause access for maintenance or to protect the service.

9. Ending your account

You can stop using TimeThis at any time and ask us to close your account. We may suspend or close an account that breaks these terms, puts the service or other customers at risk, or has unpaid fees. Before an account closes you can export your reports and files. After closure we delete customer data as described in our Privacy policy.

10. Disclaimers

TimeThis is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.

11. Limitation of liability

To the fullest extent the law allows, TimeThis will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to TimeThis is limited to the greater of the amount you paid us in the 12 months before the claim or $100.

12. Indemnity

You will defend and hold TimeThis harmless from claims by third parties that arise from your customer data, your use of TimeThis in breach of these terms, or your violation of law.

13. Governing law

These terms are governed by the laws of the state where TimeThis is organized and applicable United States law, without regard to conflict of law rules. Disputes will be heard in the state or federal courts located there.

14. Changes to these terms

We may update these terms. If a change is material, we will update the date above and let account owners know before it takes effect. Continuing to use TimeThis after that means you accept the new terms.
